Ekiti House seat: Obayemi can’t force us to go against the law –Speaker

Speaker of the Ekiti State House of Assembly, Right Honourable
(Pastor) Kola Oluwawole, has warned Mr Toyin Obayemi that he cannot
force the Assembly to act against the law of the land, saying that his
threat to drag him to court for contempt is born out of lack of
intricacies of legal workings.
In a statement by his Special Assistant (Media), Stephen Gbadamosi, at
the weekend, Oluwawole, while reacting to Obayemi’s threat in a
national newspaper that he would sue him for contempt, said the House,
as a law-abiding institution, would follow all court proceedings to
the later in all its dealings.

“After the injunction brought to the House by Mr Toyin Obayemi, there
has also been another court ruling mandating us to stay of execution
on the earlier ruling and noticing us of an appeal over the same case.


“This House is a creation of the law that cannot go against any
legitimate court ruling. But once there is a superseding court ruling,
we have to wait for the final judicial pronouncement to take any
action. Obayemi is a member of the Peoples Democratic Party (PDP) and
he should not allow the opposition to use him against his party. This
is an issue before competent courts of law. We should be careful.
There is a subsisting stay of execution and notice of appeal against
Justice Taiwo Taiwo’s ruling on the said suit No. FHC/AD/CS/17/2015,
which Mr Obayemi brought to the House. The House just must wait until
the law courts exhaust their processes before actions can be taken.

“The House cannot act against a subsisting court order that restrains
us from the purported swearing in; there is also a notice of appeal.
They were issued by a competent court of law; and bound to be obeyed
by all law-abiding institutions. Obayemi cannot claim to be an
exception under law.

“We, as a House of Assembly, cannot be stampeded by Obayemi’s seeming
judicial rascality. We believe he should allow that law to take its
due course,” Oluwawole said.

The Speaker enjoined people of the state to shun all the antics of the
detractors of the Ayodele Fayose-led government and go about their
lawful endeavours, assuring that the state was on top of every
situation.
